Over the weekend, Chile president Gabriel Boric announced plans to nationalise Chile’s lithium industry. This could be big news, mostly positive, for ASX stocks.
The plan is this. Initially, Chile’s state-owned copper mining companies CODELCO or ENAMI will serve as the state-partner in a 51/49% ownership structure for lithium project development, with a new state-owned lithium company to be created to be the future partner or sole developer of lithium projects going forward.
There will also be an explicit ban on all solar evaporation recovery methods for future projects — the main method for lithium extraction from brines — with direct lithium extraction to be the main game going forward.
Meanwhile, existing operations in the Atacama salar – which boasts 37% of global lithium reserves – owned by heavyweight miners Albemarle (NYSE:ALB) and SQM (NYSE:SQM) will be required to negotiate new operating contracts when their current contracts with the state expire.
That’s 2030 for SQM and 2043 for Albemarle.
Chile is the #2 producer in the world thanks to US$21bn capped Albemarle and US$18bn capped SQM, which were both initially punished on the news before recovering some losses in US trade Friday. Both also have strong exposure to hard rock and downstream assets in WA and elsewhere, which could soften the blow.
Albemarle has signalled the importance of WA to its future with a (rejected) more than $5 billion bid for advanced developer Liontown Resources (ASX:LTR). It already owns 49% of the Greenbushes mine and 50% of the Wodgina mine in Australia.
There aren’t many ASX stocks in Chile, and only one advanced lithium play, $200m capped Lithium Power International (ASX:LPI), which was down 6% Monday. It had recently consolidated 100% ownership of its flagship Maricunga project in the Atacama.
Jordan Roberts, battery raw materials analyst at Fastmarkets NewGen, says the immediate impact of this announcement to global production should be muted as ALB and SQM both have contracts with the government running out to at least 2030.
“We do not expect any material impact to established producers, as SQM and Albemarle’s current contracts run until 2030 and 2043 respectively,” he says.
Investor sentiment is a different matter.
“There may be some hesitation investing in Chile’s lithium space until further details have been released and companies are confident on stability and confidence in how the public-private partnerships will operate,” Roberts says.
LPI, which is looking for ~US$600m to build its 15,200tpa Maricunga project, played a straight bat to the news.
“Since the announcement of the strategy, there have been a number of differing opinions as to the effectiveness, practicality, and legality of the National Lithium Strategy and its objectives,” LPI CEO Cristobal Garcia-Huidobro says.
“LPI wants to clarify, that it believes the policy is not a ‘one size-fits all’ proposed legislation, and there are several specific elements that differentiate LPI’s Maricunga project from the rest of the existing operations or future lithium projects in Chile.
“Rather than focus on what the legislation means for the future of the Chilean lithium industry, our focus is on what it means for our Maricunga lithium project and how it will transform the Chilean lithium industry through its development.”

Most Aussie lithium miners and project developers beat the market yesterday in response. Pilbara Minerals (ASX:PLS) hit a month-high and is quietly up 16.57% year to date with a more than 5% rise yesterday.
Freshly minted NT miner Core Lithium (ASX:CXO) was up 2%, edging back over the $1.8bn cap mark, while emerging tier 1 WA play Liontown (ASX:LTR) gained 1% to $5.98bn.
MinRes (ASX:MIN) also rose sharply despite its exposure to iron ore, which had a very down day.
Expectations of an emerging cobalt deficit from 2024 are looking grim after a dispute between China’s CMOC and the DRC government over royalties was resolved, potentially unleashing a flood of cobalt onto the global market.
For the last 10 months CMOC has continued mining cobalt and copper at the Tenke Fengurme mine, building up a stockpile of at least 16,000 tonnes of cobalt hydroxide.
That’s ~10% of global annual production in a market Benchmark Mineral Intelligence predicts will be in surplus until 2026.
“With the dispute resolved, this material can now enter the global market potentially putting downward pressure on already low cobalt prices,” Benchmark Mineral Intelligence says.
“If prices continue to fall, this could push high-cost producers out of the market.”
The cobalt metal price has continued its bearish run in 2023, driven by soft demand and negative sentiment as major raw material producers, such as CMOC, announce sizeable ramp ups at their assets.
It’s not great news for besieged cobalt play Jervois (ASX:JRV), which announced plans late March to suspend final construction at Idaho Cobalt Operations (ICO) in the US.
It cited continuing low cobalt prices and inflationary impacts on construction costs as the main reasons for the decision.
Having already spent US$130m, JRV expects to complete construction and commission ICO when cobalt prices recover.
“Jervois has determined that not mining ICO cobalt at cyclically low prices will preserve the optionality and inherent strategic value of ICO for shareholders and key stakeholders including local communities and the State of Idaho,” JRV CEO Bryce Crocker said.
“The company also views not mining ICO at current prices is consistent with US Government critical mineral policy objectives.”
Opened to much fanfare last year, the mine in Salmon, Idaho, was expected to produce 1915t of cobalt, 2900t of copper and 6700oz of gold per year with an initial seven-year mine life and was to be the US’ only primary domestic source of mined cobalt.
The $200m capped stock is now down an astonishing 90% on a peak price of 98c in April last year.
