Bowdens project back on track: Silver Mines takes key step towards development approval

Special Report: Silver Mines has taken a decisive step forward in progressing its Bowdens Silver Project, lodging a formal application under recently amended NSW planning laws aimed at clarifying the path to development consent.

The move follows legislative changes passed by the NSW parliament in December 2024, which were designed to address changes to state development approval protocols resulting from a Court of Appeal decision that previously upended the project’s development approval process.

The revised Environmental Planning and Assessment Act 1979 (NSW) restores broader powers to the Planning Secretary to determine what infrastructure components are considered part of a “single proposed development” – a shift that directly benefits projects like Bowdens, which require transmission lines and other enabling infrastructure.

“This submission marks a key step in the approval process,” said managing director Jo Battershill.

“We believe it paves the way for the timely redetermination of our Development Application.”

 

Legislative reset helps clear the path

Silver Mines (ASX:SVL) had previously secured development consent through the NSW Independent Planning Commission, only to see that approval overturned by a court ruling.

The legislative fix – championed by NSW Planning Minister Paul Scully – was designed to remove this uncertainty and protect future State Significant Developments from similar legal setbacks.

With the new legislation in place, Silver Mines has applied to the Department of Planning, Housing and Infrastructure (DPHI) to determine whether the transmission line required to bring power to the Bowdens operation can be assessed separately from the single proposed development – streamlining the path forward.

The Bowdens Silver Project is the first proponent to make an application to the government under the new legislation.

If confirmed, this determination will enable the company to formally pursue redetermination of its original development application (DA).

 

A boost for regional jobs and growth

Bowdens, located near Mudgee in Central West NSW, is one of Australia’s largest undeveloped silver deposits.

Silver Mines expects the project to create approximately 220 direct, full-time jobs once operational, providing a major boost to the local economy.

“Our team has worked diligently with government agencies and we’ve been encouraged by their ongoing support,” Battershill said.

“Silver Mines remains fully committed to advancing the Bowdens Project for the benefit of all stakeholders – including the local community and broader region.”

The company has previously said it is hopeful of receiving its DA before the end of 2025, which would be a major milestone for one of the ASX’s largest primary silver projects.
